The following Terms AND CONDITIONS govern your access to and use of this website. Please read these terms of use carefully before accessing or using our website. By REGISTERING WITH our website, you agree to be legally bound by these terms of use.

1. Definitions

In these Terms the following words shall have the following meanings;


“Customer”

means each person who accesses the Website to post a Customer Service Review and complete a Customer Service Rating on-line in relation to a Member;

“Customer Service Rating(s)”

means the rating given by the Customer on the Member based on the customer service received and rated on the following scales:
1 star Unsatisfactory/ Very Poor
2 star Poor
3 star Average
4 star Good
5 star Excellent;

“Customer Service Review “

means each Customer who writes a review on the Website of their experience and dealings with the Member and its business and who completes a Customer Service Rating;

“Intellectual Property Rights”

means copyright, patent, design right (registered or unregistered), service or trade mark (registered or unregistered), data base right or other data right, moral right or know how or any other intellectual property right;

“Member”

means the individual, partnership, company or organisation who has registered with Us and who wishes Customers to post Customer Service Reviews on their business and complete a Customer Service Rating;

“Terms”

means these terms and conditions relating to the Website;

“We” “Us” and “Our”

are references to Findgoodcustomerservice Limited whose registered office is Nightingale House, 46/48 East Street, Epsom, Surrey KT17 1HQ;

“Website”

means the website located at http//www.findgoodcustomerservice.com; and

“You” and “Your”

are references to the Member.

2. Agreement

2.1 The agreement between You and Us shall come into existence when You submit Your registration details on the Website and We accept you as a Member. Please note We have the right to refuse You membership.

2.2 Your membership is for a period of 12 months unless terminated earlier in accordance with clause 4.4 below.

2.2 We reserve the right, from time to time to modify or change these Terms at any time without prior notice to You, by posting the revised terms on the home page of the Website. Your continued use of the Website following the posting of any changes to the Terms constitutes your acceptance of those changes and any subsequent use by You of the Website will be governed by the new terms of use.

3. Information provided on the Website

3.1 We allow Customers to register and access Our Website and provide feedback and opinions on Your business by completing a Customer Service Review and rate the service they have received by completing the Customer Service Rating.

3.2 You acknowledge and agree that:

3.2.1 all information in the Customer Service Review and Customer Service Ratings and which relates to Your business is provided by the Customers as written by them and is therefore public information which can be accessed by other Customers and Members;

3.2.2 We cannot and do not make any warranty or representation as to the accuracy of the information provided by the Customers nor will We be liable for any claims, damages or losses resulting from any adverse comments or reviews made by the Customers to Your business and which may have a negative impact on Your business.

4. Customer Service Ratings

4.1 You are encouraged to ask Your customers to access and register with Our Website so that they can post information and reviews and accordingly provide a Customer Service Rating on Your business.

4.2 Notwithstanding clauses 4.3 and 4.4, We may upon receipt of a negative Customer Service Review and/or a Customer Service Rating of 1 or 2 stars, contact You and inform You of the same and give You the opportunity to address the issues raised by the Customer in the Customer Service Review.

4.3 If your Customer Service rating is consistently below 3 stars then We shall notify You and give You the opportunity to rectify Your business’ level of customer service. If Your Customer Service Ratings does not increase to 3 stars or more within 30 days after notifying you of the same then We will suspend You from the Website without any liability. All negative comments posted by Customers on the Customer Service Review in relation to Your service and business on suspension will be hidden from public view.

4.4 If You want Your business to be reinstated onto the Website You must provide Us with at least three customer references which will be independently checked and verified. If these references increase Your Customer Service Rating to 3 stars or more, We will reinstate Your business back onto the Website for the remainder of the membership term. Failure to achieve a rating of 3 stars or more will automatically entitle Us to terminate your membership and all fees paid for the membership will be non-refundable.

4.5 If Your business is suspended from the Website and a Customer attempts to post a Customer Service review and Customer Service rating they will be informed that Your membership has been suspended.

4.6 We have the right to engage the services of an independent third party at any time during Your membership to report on the level of customer service You provide. We will provide You with a copy of the findings and We reserve the right to publish such findings on Your business on the Website.

4.7 Customer Service Reviews in relation to Your business shall remain on the Website for a period of 12 months from the date a customer first posts the Customer Service Review or until your membership ends, whichever occurs first.

5. Warranties and Limitation of Liability

5.1 All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded, including where permitted any implied warranties on reasonable care and skill.

5.2 We shall not be liable to You or any other party for, any direct, indirect or consequential loss, (including loss of profits, loss of contracts, business or goodwill), claim, liability, damages or losses of any kind, resulting from, arising out of or in way related to any information posted by the Customers in the Customer Service Review or in the Customer Service ratings or the content of materials or services available on or through our Website.

6. Intellectual Property

6.1 You acknowledge that all Intellectual Property Rights in the Website is and shall remain owned by Us and nothing in these Terms purports to transfer, assign, or grant any rights to You in respect of the Intellectual Property Rights.

6.2. We authorise You to use the Website for Your use only provided that you keep in tact all copyright and other proprietary notices. You may not otherwise reproduce, perform, distribute, display or create derivative works of the Website.

6.3 You may access Our Website and use any information we provide in our Website only as expressly permitted in these Terms and for no other purposes.

6.4. You agree to indemnify Us and keep Us indemnified from and hold Us on demand, harmless from and against all costs, claims, demands, actions, proceedings, liabilities, expenses, damages or losses (including without limitation, consequently losses, and loss of profit, and all interest and penalties and legal and other professional costs and expenses), arising out of or in connection with a breach of this term.

6.5 Upon the termination or expiration of Your membership with Us Your right to use Our Intellectual Property Rights (if a licence is granted) will automatically cease and all references from Your website to Us must be deleted with immediate effect.

7. General

7.1. Findgoodcustomerservice Limited is registered under the Data Protection Act 1998 and takes the privacy of its Members very seriously.

7.2 The parties to these Terms do not intend that any term of Our agreement shall be enforceable by virtue of the contracts (Rights of Third Parties Act 1999) by an person that is not a party to these terms of a permitted assignee. We may assign the agreement or any part of it to any person, firm or company.

7.3 If any provision or part of a provision is held to be invalid or unenforceable by any court or other body of competent jurisdiction, that provision or part of that provision shall be deemed severable and the other provision or the remainder of the relevant provision will continue in full force and effect.

7.4 These Terms together with any other terms signed by both parties constitute the entire agreement between the parties and prevail over any other terms of business or conditions put forward by the Client.

7.5 No variation or alteration to these Terms shall be valid unless such variation or alteration is agreed between the parties and set out in writing.

7.6 These terms of use shall be governed by and construed in accordance with English law and shall be subject to the non-exclusive jurisdiction of the English courts.
